Motor Vehicle Recycling Yards and Junk Yards
RSA 236:91, 111-129
PURPOSES. To conserve and safeguard the public safety, health, morals and welfare, and to further the economic growth and stability of the people. A clean, wholesome, attractive environment is declared to be of importance to the health and safety of the inhabitants and the safeguarding of their material rights against unwarrantable invasion.
DEFINITIONS. As per RSA 236: 91,IV “Junk” is defined as “old or scrap copper, brass, rope, rags, batteries, paper, trash, rubber debris, waste, or junked, dismantled, or wrecked automobiles or parts thereof, iron, steel, and other old and scrap ferrous or nonferrous material”.
As per RSA 236: 91, IV “Junk Yard” means any business and any place of storage or deposit, whether in connection with another business or not, which has stored or deposited 2 or more unregistered motor vehicles which are no longer intended or in condition for legal use on the public highways, or used parts of motor vehicles or old iron, metal, glass, paper, cordage or other waste or discarded or secondhand material which has been part, or intended to be part, of any motor vehicle, the sum of which parts or material shall be equal in bulk to 2 or more vehicles.
REQUIREMENT FOR OPERATION. As per RSA 236- 114 A person shall not operate, establish, or maintain a junk yard until he (1) has obtained a license to operate a junk yard business, and (2) has obtained a certificate of approval for the location of the junk yard. NOTE. The above is condensed for clarity and the actual RSA wording shall be the official wording enforced.
ENFORCEMENT. Prior to August 1, 1994, the Code Enforcement Officer shall inspect all properties within the town. Subsequently, any property failing to comply with the requirements of RSA 236: 91, 111 thru 129 will receive a written notice of noncompliance stating the reason for noncompliance.
Upon receipt of NOTICE OF NONCOMPLIANCE the property owner will have 60 days to bring the property into compliance by (A) removing junk or unregistered vehicles to a legal area (B) registering vehicles, or (C) obtaining a junk yard license.
As per RSA 236:127 Any person who is in violation of any provisions of this subdivision shall be guilty of a violation and each day of fraction thereof shall constitute a separate offense.
