Call to Order and Roll Call:
Marcia Keller, Chair opened the meeting at 7:00pm with Phil LaMoreaux, Vice Chair, Mark Keith, Erich Caron, John Pfeifle, Selectmen Representative, Jim Bibbo, Alternate, and Marge Cilley, Secretary present.
Don Jackson and John Greenwood were absent.
Marcia Keller, Chair seated Jim Bibbo for Don Jackson.
Public Hearing – Jim Bibbo – Deer Valley Road – Subdivision – Map 8, Lot 12:
Jim Bibbo stepped down.
Marcia Keller, Chair acknowledged Town Department’s responses received.
Jim Bibbo advised he is subdividing 12.1 acres from 112 acres.
Jim Bibbo presented what he is doing with subdividing. Jim acknowledged he has ZBA Variance approval on July 13, 2013.
Marcia Keller, Chair opened the floor to the Public.
There being no public comments, Public Hearing was closed.
Deed description was received.
Motion was made by Phil LaMoreaux, Vice Chair to accept the Application for Subdivision for Jim Bibbo as being complete, Deer Valley Road, Map 8, Lot 12. Seconded by Erich Caron. Motion carried 4-0.

Marcia Keller requested the Zoning Board be more specific on their Notices of Decision or forward a copy of the Application to the Planning Board.
William Churchill Heselton – Conceptual Consultation re: Boundary Line Adjustment – Map 9, Lots 45 & 58:
Paul Dobberstein, Surveyor/Project Manager, Eckman Engineering represented William Churchill Heselton. Mr. Dobberstein went over the map/plan that he handed out to the Board for the Boundary Line Adjustment on County Road and Rowe Mountain Road. Mr. Dobberstein advised he is doing work for Scott Hill who was logging the piece. It was stated all of the skidder road (1.3 acres) will be added in and all the pins have been set.
Marcia Keller, Chair re-seated Jim Bibbo.
Marcia Keller, Chair stated that she heard from an Attorney that as a caution, it is advisable to let banks know of changes via a Boundary Line Adjustment.
Public Hearing will be on Tuesday, February 11, 2014.
Conceptual Consultation – Chris Payson – West Road – Subdivision – Map 4,
Lots 21, 24, 25 and Lot 5:
Paul Dobberstein, Surveyor/Project Manager, Eckman Engineering represented Chris Payson. Mr. Dobberstein advised the proposed application is to divide Lots 21, 24 and 25 in two, making each individual lot into two lots, with the remainder of Lot 24 being annexed into Lot 5. After discussion, this is considered a major subdivision by the board.
This is in the Rural Residential district. A waiver may be requested from ZBA. Also waivers may be requested for Topography Mapping and Wetlands Mapping to prove buildable areas, and not for the entire parcel. There is a stream going through Lot 21.
The State Subdivision requirements have been met per Mr. Dobberstein. There will be six buildable lots with an additional 23 acres being added onto Lot 5, for about 100 acres. Marcia Keller reminded them of the Driveway Access.
The Application will be forthcoming.
Review and Consideration of the December 10, 2013 minutes.
Motion was made by Phil LaMoreaux, Vice Chair to approve the December 10th minutes as presented. Seconded by Mark Keith. Motion carried 5-0.
To Do Folder:
Acknowledgement of a Site Plan Revision received from Valley Fire regarding the parking of school busses, now on Route 114.
Zoning Amendments Wording – Special Exception:
After much discussion of the proposed Amendments, the following Motions were made.
Zoning Amendment one:
To see if the Town will vote to amend Article V.Section C. 1. to read:
When any existing non-conforming use of a building or use of land has been discontinued for two years, the building or land shall thereafter be used only in conformity with this ordinance,(except by special exception. ) Strike except by special exception.
Motion was made by Phil LaMoreaux, Vice Chair to move forward with the corrected wording of Zoning Amendment One. Seconded by Mark Keith. Motion carried 5-0.
Zoning Amendment Two:
To see if the Town will vote to add a definition to Article 11. Definitions Feather Sign:
Any sign constructed of cloth, canvas, fabric, plywood, or other light materials and support along one or more sides and intended for display for a short period of time.
Motion was made by Phil LaMoreaux to strike the word plywood and approve the amendment as written and put forward for the Public Hearing. Seconded by Erich Caron. Jim Bibbo voted Nay. Motion carried 4-1
Zoning Amendment Three:
To see if the Town will vote to amend Article VII Sign Regulation to allow feather signs under the category of “allowed without permit”, but set criteria for their use.
Feather signs allowed in the Rural Business District with a limit of two
per lot, 15’ from the highway right-of-way and abutting property, kept in
good repair, and displayed for no longer than 60 days in any calendar year.
Motion was made by Phil LaMoreaux to move forward with Amendment Three and strike abutting and add BOUNDARY after the word property. Motion seconded by Erich Caron. Jim Bibbo voted Nay. Motion Carried 4-1
After discussing the existing sequence of the Amendments it was agreed they should stay in the original order.
Zoning Amendment Four:
John Pfeifle, Selectman Representative explained that the town is cleaning up areas and trying to attract people and industry into town. The East side sidewalks have been done and West Main is being worked on. The Attorney’s comments were read and comments discussed.
To see if the Town will vote to amend Article IV.B. Residential Business District 1.c. Provisions to add as 9): Unless being displayed publicly, restored, associated with the legally operating business on the property, including home occupations, or being used to support a restoration effort of a similar vehicle, not more than one commercial, industrial, bus, heavy equipment or vehicle greater than 10,000 pounds, excluding air craft, not registered in the last year, shall be located on a property, Such vehicles shall not be inhabited year-round; this does not apply to manufactured housing or mobile homes.
Motion was made by Phil LaMoreaux to move forward on Amendment Four with the following wording for the Public Hearing to be scheduled for Tuesday, January 28, 2014 at 7:00pm.
P. Restriction on Certain Vehicles in the Residential-Business District. The following restrictions apply to all lots in the Residential-Business district, whose primary use is residential:
1. No commercial vehicle recreational vehicle, trailer (excluding manufactured housing), truck over 15,000 gross vehicle weight rating, bus, or boat shall be parked or stored outdoors within 50’ from any street right-of-way or property line.
2. The restrictions set forth in paragraph 1 above shall also apply to any other type of vehicle which remains in the same location, without being operated on the public highways, for a period of 60 days or more, irrespective of whether said vehicle constitutes “junk” under this Ordinance.
3. Notwithstanding Article V of this Ordinance, no existing vehicle, trailer or boat shall be deemed to constitute a nonconforming use, or to be otherwise exempt from the restrictions contained in this section. However, any owner may apply for a variance pursuant to the standards contained in RSA 674:33. Motion seconded Erich Caron. Motion carried 5-0.
These Zoning Amendments will be posted in the usual places in town as well as in the January 17, 2014 Concord Monitor.
Application increase to cover cost of Labels for Certified Mailings:
To be brought up at a later date.
ZBA Decision on ATM Lighting for Bradford Depot:
Decision not available at this time.
Marcia Keller, Chair commented about possibly combining Planning Board and Zoning Board records, as they all pertain to the property maps.
Marcia requested. a letter be written to the Zoning Board of Adjustment requesting additional information be included in the Notice of Decision or a copy of the Application for their files.
Site Plan Review Application Required:
An application for a Site Plan Review needs to be forwarded to Gateway Rentals, Breezy Hill Road, Map 3, Lot 7, and Map 3, Lot 82c
Reference to letter to Martyn Chivers:
Letter will need to be written regarding where Mr. Chivers is on the conditions needing to be met. Suggestion was to wait until July.
