April 8, 2008
Call to Order and Roll Call
Phil LaMoreaux, Chair called the April 8th, 2008 meeting to order at 7:00pm with Barbara Vannata, Sonny Harris, Barry Wheeler, Bill Glennie, Andrew Pinard, Selectmen for Charles Meany, Jeff Aarons, Alternate, Jim Bibbo, Alternate and Ian Thomas, CNHRPC. Marcia Keller was absent.
Phil LaMoreaux, Chair seated Jeff Aarons for Marcia Keller.
Motion was made by Barbara Vannata to approve the March 11, 2008 minutes, seconded by Barry Wheeler. Motion carried to approve as presented.
Seating of Alternates:
Motion was made by Barry Wheeler to appoint Jim Bibbo as an Alternate member of the Planning Board for three years. Seconded by Sonny Harris. Motion carried 6-0.
Jane Johnsen and Jim Bibbo’s Alternate papers were signed by the board members, now they need to be sworn in by the Town Clerk.
To Do Folder was reviewed:
Annexation plans for Ledgewood Pines received and will be reviewed at a later date.
This includes the boundary line adjustment between Ledgewood Pines and Ken Anderson.
Revisions to the Pizza Chef Site Plans. Building Inspector advised he did not have a copy of the site plan, therefore did not approve the plan. It was brought up that it would be hard for the Planning Board to approve a Site Plan then have it go to the Code Enforcement officer for a building permit. Perhaps the Planning Board should contact the Selectmen and recommend that the Building Inspector not issue a building permit for any commercial property until he has reviewed the Site Plan for compliance. Due to circumstances, the proposed 720 square foot addition is now 850 square foot. This will require some further checking on and will be put on hold for now.
Preliminary Consultation:
Kevin Cahill for Eric Engheben, Rowe Mountain Rd. Map 11, Lot 16, Re: Issuance of a Building permit on a class VI road.
Kevin Cahill came before the Planning Board for Eric Engheben regarding a Building Permit on a Class VI Road. It has already been to the Board of Selectmen; however, the Selectmen can only approve the building permit after the Planning Board input. Andrew Pinard advised the Selectmen, by statute, must seek input from the Planning Board, and once provided, the Selectmen have the right to approve or deny any building permit associated with anything on a Class VI road. Andrew also advised it would be an agriculture facility with proposal of it being a sugar bush orchard. A timber frame barn is proposed, with no residence.
Ann Eldridge and Brooks McCandlish, Conservation Commission had questions. Brooks also advised that the Municipal Association recommends against building on a Class VI road for various reasons.
Motion was made by Bill Glennie to recommend the Selectmen deny the Building permit. Jeff Aarons seconded.

Motion defeated 4-2.
Motion was made by Barbara Vannata that the Planning Board recommends to the Selectmen to approve the building permit for a barn with the stipulation there will be no buildings for residential purposes. Barry Wheeler seconded.

It was requested that whatever letter is forwarded to the Board of Selectmen, the waivers as well as the results of the vote should be included. Phil LaMoreaux, Chair will prepare a letter to the Selectmen.
CONTINUATIONS:
Bruce Edwards, Gravel Pit, Pleasant Valley Road, Map 7, Lot 26:
Phil LaMoreaux, Chair advised the new Planning Board members that a Site Plan Modification and Gravel Pit Application was conditionally approved on July 10, 2007. The conditions of approval were:
1. ZBA approval of wetlands variance setback.
2. DES Site Specific.
3. A signed copy of the letter between Hill & Dale and the Bradford Road Agent.
All three conditions are in the file.
Bruce Edwards brought in maps which the members perused at this time.
Motion was made by Bill Glennie to honor the permit application since it was filed with the Site Plan Application with the date of approval of April 8, 2008. Seconded by Jeff Aarons. Motion carried 7-0.
When this expires in two years, (April 8, 2010) a new permit application will need to be filed under the new excavation permit. Bruce advised he needs a Permit #.
Bruce will give bond information to the Planning Board for their files.
NEW BUSINESS:
Barry Wheeler – Gravel Pit – Center Road – Map 2, Lot 104:
Barry Wheeler recused himself as Planning Board member to discuss his Excavation Permit Application.
Phil LaMoreaux, Chair advised several abuttors had sent letters regarding the Gravel Pit.
He also advised that there have been comments in the past, and he wants to diffuse any questions people have. There has been concern about gravel crushing in the pit, and this gravel pit application does not deal with that.
Also it was noted that Mr.& Mrs. Burton Hersh and Mr. John Greenwood’s certified letters were returned as being undeliverable. Mr. John Greenwood was in attendance tonight.
In reply to a question from Andrew Pinard, Selectman, the Planning Board has not requested a review from CNHRPC regarding gravel pits.
Phil LaMoreaux, Chair went over all material in the Excavation Permit. With the application is a request for waivers, dated March 17, 2008, as follows:
1. No. 19 Request of surety bond of $1,000.00 or more to be waived. The Gravel Pit has a reclamation plan.
Motion was made by Andrew Pinard to waive the $1,000 surety bond. Seconded by Bill Glennie. Motion carried 6-0.
At this time, Phil LaMoreaux, Chair read into the minutes comments from Marcia Keller dated April 3, 2008. Comments on file.
2. No. 3 Includes a locus map at a scale of 1”:1000’ showing the proposed operation in relation to existing roads, water bodies, ponds, third order streams, and aquifers. Requests waiver and allow 1”:200;
Motion was made by Bill Glennie to grant the waiver request. Seconded by Jeff Aarons. Motion carried 6-0.
3. No. 7 Request a waiver of highest average groundwater table.
Motion was made by Jeff Aarons, seconded by Andrew Pinard for waiver for the ground water table elevation. Motion carried 6-0.
It was decided this is NOT something that can be waived.
It was pointed out that there are two gravel pit areas, A & B and that A has to be completed prior to Plan B.
Phil LaMoreaux, Chair advised the application can be approved, but prior to finalization, prior to granting any permits, there must be proof of performance bond.
Motion was made and seconded to waive the 5 copies required, and accepting the one existing copy.
Motion carried 6-0.
Motion was made by Bill Glennie to waive the application requirement for Certified Wetland Scientist stamp. Seconded by Sonny. Motion carried 6-0.
The Conservation Commission should have a copy of the plan and a copy of the application allowing them to review it and submit a separate page that states they’ve reviewed it. Barry will get this for them for their next meeting.
Motion was made seconded and carried for a Surety Bond for reclamation carried at $5,000.00.
This Hearing will be continued on the May 13, 2008 regular Planning Board meeting.
Christine Bowie questioned Barry Wheeler how the gravel will be transported out, to which he replied it will be out the other drive, not on Water Street.
Robin Sanborn – Main Street – Site Plan Application Hearing, Map 17, Lot 49:
Robin Sanborn came before the Planning Board for a Site Plan Application.
This is for a transportation based business and this is a first Public Hearing.
There is no change to property. A hand drawn plan was presented. This is a contract out with other businesses.
Motion was made by Andrew Pinard to waive all requests but numbers 26, 27 and 29. Seconded by Sonny Harris. Motion carried 5-0.
Motion made by Andrew Pinard to waive No. 26. regarding Buffers. Seconded by Sonny Harris. Motion carried 6-0
Motion made by Andrew Pinard to waive No. 27 regarding Screening. Seconded by Sonny Harris. Motion carried 6-0
Motion made by Barry Wheeler to waive No. 29, regarding Erosion & Sedimentation. Seconded by Sonny Harris. Motion carried 6-0.
Motion was made by Andrew Pinard to accept the application as complete. Seconded by Barry Wheeler. Motion carried 6-0.
Phil LaMoreaux, Chair opened the floor to the public, and closed to the public there being no comments.
This Site Plan will be continued until the next meeting and will be held early.
All Departments will be notified. (Done on April 9, 2008).
