Selectmen’s Minutes 08.23.21

Select Board Meeting called to order at 5:30 pm

Roll Call – Andrew Pinard (Chair), Marlene Freyler, Mel Pfeifle and Karen Hambleton, Town Administrator, were in attendance.

Appearances:

Cleveland Waters & Bass – Dillon – Attorney Morgan Tanafon, representing Mike and Stacey Dillon, said they are hoping to move forward with their business. Andrew said the Dillons will need to go through the application process with the Zoning Board of Adjustment. Matt Decker, Bradford Town Attorney, said a home business is a permitted use throughout the Town of Bradford, however the use that is being done at this property does not fall under the use of a home business and therefore will need Zoning Board approval. Discussion ensued regarding the fact that the Dillons were shocked to receive a cease-and-desist order while they were still going through the process. Andrew explained that the Select Board disagreed with the recommendation of the Code Enforcement Officer and issued the cease-and-desist order recommending the property owner go through the Zoning Board and Planning Board process.

Erica Gross – Sign Deeds – Erica witnessed the Board members signing the four deeds for the properties the Town has deeded for non-payment of taxes.

Mark Anderson – Mark’s wife Alisa had submitted a letter regarding damage to her car going over a town road that occurred on July 30, 2021. Andrew read from the Knowing the Territory 2020 Handbook that the NH Municipal Association puts out. Andrew said there were no prior reports that the road damaged before this incident happened. Andrew said that Mark’s wife’s email indicated she saw the damage to the road prior to trying to drive over it, and then continued to drive over it. Mark is asking if he could get reimbursed for their insurance deductible. Andrew said they will look into it with the Town insurance company. Karen will get back to the Andersons after they contact the insurance company.

Sal Magistro Update – Sal gave an update on his proposal for his bakery. He said he has filled out all his paperwork for the Planning Board. He also met with the Fire Chief and Police Chief and knows what information he needs to get to them. Sal said all three doors need to open out. The Fire Chief said the fire detectors need to be wireless on the main floor and the second floor. Sal said all this work would be done at his expense. Sal said there is a 1,000 gallon septic tank on the property. Marlene said she called DES to see if the State has records for a septic design on this property. Sal would like to propose a lease with the Town. Marlene said the lease would only be for one year. Karen asked if Sal has the key to the building and he said yes, he received it from Steve Hanson. Karen then asked if he has looked at the right of way, and Sal replied yes. Andrew asked how many employees there would be, and Sal replied two. Andrew asked Sal to submit a proposal and the Select Board will look at it.

Public Input:

George Angeli had a question regarding a home-based business. Andrew read directly from the Zoning Ordinances. George then asked if a homeowner in Bradford could run a business from a different property owned by the homeowner but not the one their home is on Andrew read the definition of a home business from the Zoning Ordinances. After reading from the ordinances Andrew said it is his understanding that if the business is not running out of the home, it would need to be considered a regular business.

Regular and Old Business

  • The Board reviewed the minutes of the August 9, 2021 meeting.

  • The Accounts Payable and Payroll Manifest were reviewed and signed.
  • Fuel Bids Update – Karen reported on the fuel prices that she locked in for the Town.
  • Letters to the Town – Andrew acknowledged letters that were sent to the Select Board from the Conservation Commission, Rebecca Herman, Brooks McCandlish, the Bradford Community Church Trustees and Pam Bruss on behalf of the Planning Board.
  • 340 Fairgrounds Update – Karen gave an update on this property. The Code Enforcement Officer has spoken to a resident of the property but not the property owner yet. She said the Town is following the legal process in looking at the vehicles on the property. Andrew said they are actively continuing to make sure that we take proper steps to address the concerns they still have for the property. Karen said the property owner has asked that all communications to/from the Town go through her. Rebecca Herman asked who the Town used to clean up this property in the past. Karen said there were numerous people involved in the process. She will send Rebecca a list. Rebecca then asked if the Town has had any correspondence from DES. Karen asked Rebecca to submit a formal request via email so that all her questions could be answered. Andrew read a letter and a follow-up email from the Conservation Commission regarding this property. Beth Downs asked if the property owner has been sent the bill from the previous clean-up and Karen replied yes. Beth wants things to move a bit faster to deal with this issue. Andrew said they are continuing to work towards resolution.

New Business:

  • American Rescue Plan Act – Karen said they submitted the request, and she is waiting to hear back.
