ZONING BOARD OF ADJUSTMENT

Call to Order and Roll Call:
Brooks McCandlish, Chair called the meeting to order at 7:00pm with Nancy McEachren, Andrew Pinard, Bill Glennie and Marge Cilley Secretary present. Richard Dionne was absent.
Review and Consideration of November 2, 2011 minutes:
Withheld until everyone has seen a copy to review.
Review of Conditions of Corsair Realty. LLC-Harriet Hobbs, Mgr. Gravel Pit Special Exception Map 7, Lot 29:
Andrew Silobich, Pathways Consulting, LLC came before the Zoning Board of Adjustment representing Harriet Hobbs, Corsair Realty.
Brooks McCandlish, Chair advised that the ZBA received a Certification from Pathways Consulting, LLC., the SWPPP preparer and monitor of Storm Water Practices were in place. Brooks stated they did receive this as an e-mail and understands there is a hard copy. The Board did receive the Certification.
Andrew Silobich advised he met with Ed Hauck on Monday and they walked the site, starting at the upper end of the site where the culvert was removed, where it was channeling down on to adjacent property, and that channel has been blocked up. They went down towards the access road ,and Ed had cut in an additional drainage ditch that cuts back into the site, so any water that makes it that far down into the site gets picked up and goes into a little settling pond from which it percolates out into the sandy material on site. The stone lined ditch was installed as per plans as were the check dams. Hauck has stabilized the construction entrance installed from the existing access gate up into the site. From the existing access gate down to Pleasant Valley Road, it is not currently installed, but has it sanded because he intends to plow up to the gate to allow access to a little parking area. Andrew advised he stated to Mr. Hauck that once construction activity begins, that sand needs to be stripped off and the construction entrance extended down to the road to prevent sediment from being tracked out from trucks going through. The other issue he saw that was not up to code with SWPPP, hasn’t installed the construction fence along the northern boundary hasn’t been installed. Mr Hauck advised as soon as construction starts he will do that. He did not want to do it and have snow and trees fall on it and have to pull it up. Mr.Silobich expressed to Mr. Hauck that prior to any gravel removal those two items need to be done, to which Mr. Hauck agreed.
Brooks McCandlish, Chair advised that when he walked the property in September, after some heavy rains there was a considerable gully running through the middle of the pit and going straight out down the access road. Mr. Silobich advised if you stand in the pit and looking down the access road, that’s where Mr. Hauck cut the channel that goes diagonally across, so if anything comes from the upper part of the site, it will hit that and go to the pond via a berm that has a pipe through it. It does need to be maintained.
Brooks McCandlish, Chair stated that it appeared in September that water had been running down skid trails leading directly into the pit area which was the source of the water that had been running through. Was anything done other than blocking that one culvert to protect the pit itself from water coming from up slope? Mr. Silobich advised this was not addressed on the SWPPP, the biggest thing in the SWPPP and erosion monitoring was to keep silt from moving off the site. There is a little bit of vegetation up there that will help, but once they start pulling gravel out that will all change.
Brooks McCandlish, Chair asked for questions from the Board.
The SWPPP plan was checked out by the Board.
Nancy McEachren questioned if Pathways Consulting, LLC has been hired to do the inspections? Andrew Silobich stated he thinks they will do the monitoring of storm events, and in New Hampshire, anything over ½ inch is considered a storm in a 24 hour period of time. Nancy questioned if these are detailed and recorded within the company to which Andrew said yes.
Brooks McCandlish, Chair questioned if Inspections and Maintenance from this plan, are those in effect already? Andrew Silobich advised he is not sure right now as the site is not being actively worked, but they have the measures in place, and he will have to check with his office on that. Brooks McCandlish, Chair suggested that the reason Pathways Consultant is here tonight was because of whatever was happening, that if regular monitoring was happening, at least some of that might have been avoided. Andew Silobich stated he will have his office contact Brooks via e-mail regarding if monitoring is in effect now.
Andrew Pinard advised the condition specifically was that Best Management Practices to control Storm Water flowing onto and through the project are in effect — does that include the monitoring or is this the plan prior to activity? Brooks McCandlish,Chair advised it would mean the practices are in effect, monitoring was specified in the plan, there should be monitoring.
Andrew Silobich stated that once there is snow cover that stabilizes the site, you do not get the run off, but once spring thaw comes they really start to watch it.
Motion was made by Bill Glennie that the Storm Water Pollution Prevention Plan verification has been received and been accepted for the Corsair Realty Gravel Pit on Pleasant Valley Road, Map7, Lot 29, a condition of the approval of the Special Exception. Seconded by Andrew Pinard. Motion carried 4-0.
Harriet Hobbs will be notified that the second condition has been fulfilled. The Zoning Board of Adjustment encourages that the monitoring continue.
Andrew Silobich, Pathways Consultation, LLC advised he will get everything figured out and start monitoring as needed to keep the site clean and keep the sediment from getting out in the road and getting off site.
Review ZBA Rules of Procedure and Forms:
Pursuant to the November meeting, Andrew Pinard had made some changes and updated the ZBA Rules of Procedure which were handed out to the Board and were gone over by the Board and edited.
Motion was made by Andrew Pinard to waive previous procedure and to implement those Amendments so the updated Rules of Procedure will be effective at the January 4, 2012 meeting. Seconded by Nancy McEachren. Motion carried 4-0.
Andrew Pinard will forward copies of the updated Rules of Procedure to everyone.

Total Zoning Budget $700.00
Motion was made by Andrew Pinard to approve the three lines under the Zoning Board of Adjustment Budget as presented, which is the same as total last years budget. Seconded by Bill Glennie. Motion carried 4-0.
Brooks McCandlish will forward this to Cheryl Behr, Administrator prior to the Selectmen’s Tuesday night meeting.
Motion was made by Andrew Pinard to appoint George Cilley as an Alternate to the Zoning Board of Adjustment. Seconded by Bill Glennie. Motion carried 4-0.
There being no other business to come before the Board, meeting adjourned 8:15pm.
